We have for review Pennell v. Keene Brothers Trucking, Inc., 589 So.2d 965 (Fla. 2d DCA 1991), which we find directly conflicts with Frazier v. Seaboard Systems Railroad, 508 So.2d 345 (Fla. 1987). In the instant case, the district court held that the trial court had no authority to simultaneously grant a new trial and a judgment notwithstanding the verdict in the same order. For the reasons expressed, we quash the decision of the district court and remand this cause for a new trial.
